End User License Agreement (EULA) & Terms of Service
Last Updated: October 27, 2026
Welcome to FG Vector. Please read this End User License Agreement ("Agreement" or "EULA") carefully before installing or using the FG Vector mobile application, including all related features, automated analytics, the companion apps for Apple Watch and compatible Garmin watches, and camera-based analysis technologies (collectively, the "Application").
By downloading, installing, or clicking an opt-in button to accept this Agreement, you agree to be bound by this Agreement. If you do not agree, do not install or use the Application. How we process personal data is explained in our Privacy Policy.
If you downloaded the Application from the App Store, Apple’s standard Licensed Application End User License Agreement also applies to your licence to use the Application; this Agreement supplements it.
1. The Contracting Parties
This legal contract is entered into by and between you, as an individual user ("User" or "you"), and the application operator and product manufacturer:
Corporate Entity & Operator:
Company Name: falbergolf.com, s.r.o.
Registered Address: Bystrcká 1137/38, 624 00 Brno, Czech Republic
Company ID (IČ): 26956608
VAT ID (DIČ): CZ26956608
Commercial Register: Regional Court in Brno, file C 47909
Contact Email: [email protected]
Website: falbergolf.com
Minimum age: You may use the Application only if you are aged 13 or over; the Application does not accept a date of birth indicating an age under 13. Some features rely on processing of personal data that requires your consent — the Personal AI Coach (section 7) and the Community Features, including a public profile and posts (section 8). If you are below the age at which you can give that consent yourself in your country (under Article 8 GDPR this is 15 in the Czech Republic, 16 in Germany and several other countries, and between 13 and 16 elsewhere in the EU), you may use the Application and these features only with the consent of your parent or legal guardian, and by accepting these Terms you confirm that your parent or legal guardian has given this consent both to your use of the Application and to the processing of your personal data in these features. Eligibility of minors for prizes is governed by section 12.1. Parents or guardians who believe that a child is using the Application without the required consent can contact us at [email protected]. If we learn that a user is under 13, we will delete their account.
2. Scope of License Grant and Protection of Our Technology
Subject to your strict compliance with this Agreement, falbergolf.com, s.r.o. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and operate the Application on authorized iOS and watchOS devices owned or managed by you solely for personal, non-commercial use. Features that require a subscription (section 5) are available only during your free trial or while your subscription is active. The license is tied to your account: you must not share your account or let other people use the Application through it. This license also covers the FG Vector companion app for compatible Garmin wearable devices (distributed via the Garmin Connect IQ store), which mirrors selected live training data on your Garmin watch.
2.1 Our technology and know-how
The Application and the technology behind it — in particular its software, the methods by which it derives shot statistics from camera, audio and motion data, its processing models, parameters, thresholds, calibration values and reference tables (including those the Application downloads from our servers), the structure of our server interfaces, and the know-how embodied in all of these (together, “Our Technology”) — are the result of substantial investment by falbergolf.com, s.r.o. Our Technology is protected by law, in particular as a computer program and, where applicable, as a database. Those parts of Our Technology that are not publicly known, in particular the know-how behind the measurement, are our trade secrets; we keep them confidential and protect them by technical and contractual measures, including this section. This Agreement gives you no rights to Our Technology other than the licence to use the Application described above; all other rights are reserved. We expressly reserve the use of the Application and Our Technology for text and data mining within the meaning of Article 4(3) of Directive (EU) 2019/790. The restrictions in this section supplement those in Apple’s standard Licensed Application End User License Agreement.
2.2 What you must not do
Except to the extent that mandatory law expressly permits it (section 2.4), you must not do any of the following, and must not allow, instruct or help anyone else to do so:
- Copy or modify: copy, modify, translate or adapt the Application or any part of it, or create derivative works of it, except to the extent necessary to install and use it on your devices;
- Reverse engineer: reverse engineer, decompile, disassemble, decrypt, unpack or otherwise analyse the code, installation package, files, libraries or models of the Application, or attempt to derive its source code, algorithms, models or parameters;
- Intercept communication: intercept, record or analyse the communication between the Application and our servers (for example with a proxy or another interception tool), or access our servers, interfaces, databases or configuration other than through the unmodified Application used in the ordinary way;
- Circumvent protections: circumvent, disable or interfere with any security feature, integrity check, access control or usage limit of the Application or of our services;
- Automated access and scraping: use bots, scripts, scrapers or other automated means to access the Application or our services, or to collect data, content, results or configuration from them;
- Extract Our Technology: extract, copy or collect the parameters, thresholds, calibration values, models, reference tables, server configuration or other parts of Our Technology;
- Build a competing product: use the Application, its outputs (such as shot statistics, analyses and measurement diagnostics), Our Technology or any information obtained in breach of this section to develop, train (including training or fine-tuning machine-learning or other artificial-intelligence models), calibrate, test, validate or benchmark a product or service that measures, estimates or analyses golf shots or golf swings or that otherwise competes with the Application, or systematically collect such outputs for any of these purposes;
- Commercial exploitation: rent, lend, sell, sublicense or otherwise make the Application or Our Technology available to anyone else, for example by letting others use your account, or use them to provide services to third parties.
2.3 Confidentiality of our know-how
If you obtain any of our trade secrets, in particular any non-public part of Our Technology, you must keep it confidential and must not use or disclose it, unless it is or becomes publicly available other than through a breach of this Agreement, you developed it independently, or mandatory law entitles you to use or disclose it. Information obtained by decompilation that the law permits in order to achieve interoperability may be used only for that purpose; in particular, it must not be given to others except when necessary for interoperability, and must not be used to develop, produce or market a program substantially similar in its expression to the Application, or for any other act that infringes copyright.
2.4 Your rights under mandatory law
Nothing in this section restricts:
- acts that you are entitled to perform under mandatory law and that cannot be excluded by contract — in particular, in the EU, observing, studying or testing the functioning of the Application in the course of its ordinary use in order to determine the ideas and principles underlying it, and decompiling it to the extent indispensable to achieve the interoperability of an independently created program, under the conditions of Articles 5(3) and 6 of Directive 2009/24/EC and of the national laws implementing them (in the Czech Republic, Section 66 of Act No. 121/2000 Coll., the Copyright Act);
- your rights to access, obtain a copy of and transfer your own personal data, including your shot statistics, under the GDPR and our Privacy Policy; your freedom to use your own results for your own purposes and to share them; or your right to publish your honest opinion of the Application, including comparisons with other products;
- the rights granted by the licences of open-source software components and of third-party data included in the Application (for example, golf course data © OpenStreetMap contributors, available under the Open Database License), which govern those components and data;
- the use or disclosure of information where the law permits or requires it, for example to report unlawful conduct to the competent authorities.
If a restriction in this section cannot be applied in your case under the law that applies to you, it applies to the greatest extent that law permits, and the other provisions of this section remain in force.
2.5 Consequences of a breach
If you breach this section, we may suspend or terminate your account and your licence to use the Application. We act proportionately; unless the law prohibits it, we tell you the reason for our decision, and you may contest it by writing to [email protected]. We may also exercise the rights that the law gives us in respect of the breach, including under the law on copyright, trade secrets and unfair competition — in particular to require you to stop the infringing conduct and remove its consequences (including destroying copies and materials created in breach of this section), to claim compensation for damage and to claim the surrender of any unjust enrichment. Your statutory rights remain unaffected. The obligations under this section continue to apply after this Agreement ends or your account is deleted.
3. Zero-Touch Technology & Down-The-Line Premise
The Application is built upon proprietary technology. By using the system, you acknowledge and agree to the following operational parameters:
- Fixed Camera Reference Frame: The Application is designed exclusively for the "Down-the-Line" (DTL) camera view angle (positioned directly behind the player looking down the target line). The system does not support and will not process any alternative camera angles.
- Zero-Touch Capture Loop: The Application monitors your stance setup through the lens without requiring audio triggers. Once a stabilized address position is identified, data tracking and swing recording commence automatically.
- Automatic Shot Validation: To keep your statistics consistent, the Application may automatically mark certain recorded actions as invalid ("Not captured") and exclude them from your session statistics.
4. Data Acquisition, Storage, and Improvement of the Measurement
The Application derives estimated shot statistics (such as carry, ball speed, club speed and launch angle) from camera, audio and motion data, and we continuously refine its processing models across different lighting and environmental conditions. How we process personal data is described in our Privacy Policy; in summary:
Measurement Diagnostics: For each shot, the Application stores a small technical diagnostic record in your cloud account (for example, why a ball measurement succeeded or failed, the processing stages, the device model, camera settings and the selected club). We use these records, and aggregated or anonymised statistics derived from them, to improve the measurement. They contain no video and no images. Aggregated or anonymised statistics that no longer identify you may continue to be used after your account is deleted.
Use of App Features: The Application records simple signals about the use of some of its features (for example, whether the end-of-session card was shown or whether you opened the evening summary), and we evaluate them in aggregate, as described in section 1 of our Privacy Policy. This is based on our legitimate interest, not on your consent; you can object to it at any time by e-mail to [email protected].
Your Videos: Recorded swing videos are stored and processed on your device. Our cloud synchronises numerical statistics, performance metrics and session data; your video library is not backed up to our cloud. A video leaves your device only if you choose to publish a shot as a post in the Application (section 8), to share it to another app through the iOS share sheet or to attach it in the support chat, or as a diagnostic shot video: if the ball is measured on fewer than 60% of the shots in a camera session, the Application uploads a few clips from that session so that we can improve the measurement, as described in section 2 of our Privacy Policy. Videos are not used to train AI models. Managing the videos on your device remains under your control.
5. Trials, Paywall Restrictions, and Monetization
The Application starts with a free trial of 5 training sessions with no time limit; after the trial, recording new shots and some features require a subscription.
- The 5-Session Full Trial: For 5 training sessions, you receive free access to all features of the Application except the public profile. For the purposes of the trial, a training session is a calendar day on which at least one real shot is recorded in the Application; practice swings do not count, and further shots recorded on the same day do not use up another session. The trial has no time limit: sessions are used up only by recorded shots, not by installation, registration or the passage of time. A day on which a training session has been used up can be finished in full, including the fifth one: after the last session of the trial, a subscription is required from the following calendar day. The trial is available once per device and is shared by all accounts used on it: training sessions recorded on a device by accounts without access to FG Vector Pro count towards the trial of every account on that device, and the training sessions of your account count on every device on which you sign in. Accounts with access to FG Vector Pro — an active subscription (including one obtained with an Offer Code) or access granted by us, for example in a promotion — can be used on any device without this limit, and their sessions do not count towards the trial on that device. For accounts created before November 3, 2026, the trial continues to be counted per account, as under the previous version of these Terms.
- After the Trial: Once all 5 training sessions of the trial have been used, recording and measuring new shots (the Training tab), writing to the AI coach, the public profile and FG Lab require an active subscription to the FG Vector Pro plan. Your shot history including shot videos, statistics, bag, coach reports and profile stay accessible without a subscription. Your data is not deleted when the trial ends, and your rights described in the Privacy Policy (including obtaining a copy of your data and deleting your account) remain available.
FG Vector Pro Unlocks:
- FG Lab: Access to experimental features such as ball flight curves, which you can switch on and off in your Profile.
- Swing Quality Insights: Automatic evaluation of your swing with every recorded shot.
- Shot Estimates: Estimated club speed, ball speed, carry and launch for every recorded shot, to follow your training trends.
- Personal AI Coach: A one-on-one chat with your personal virtual golf coach.
- AI Audio Coach: Completely voice-assisted training session feedback delivered directly to wireless earphones.
Bag Manager, the synchronization and backup of your data in the cloud, and reading your AI coach reports remain available without a subscription.
FG Vector Pro is an annual auto-renewing subscription billed through your App Store account; the price is shown in the App Store before you buy. The subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel it at any time in your Apple ID account settings. Payments, cancellations and refunds are handled by Apple under its terms; your statutory consumer rights are not affected. Offer Codes for FG Vector Pro (for example, as a gift with an order from the falbergolf.com e-shop) are redeemed through the App Store; the subscription is sold and unlocked only through Apple.
6. Ball Flight Curves (FG Lab) Limitations
Ball flight curves are an experimental FG Lab feature that you can switch on and off in your Profile. The curve displayed over your shot video is a computed visualization of the estimated ball flight, not a literal optical recording of the ball in midair. Because it is a model, the curve and the landing spot shown may differ from the actual flight of the ball, for example due to wind, lighting or camera position. All displayed statistics are estimates intended for training purposes and are not certified measurements.
7. Personal AI Coach & Chat
The Application includes a personal AI coaching feature that automatically prepares a daily training report after a qualifying practice session and allows you to chat with a virtual coach persona. By using these features, you acknowledge and agree that:
- AI-Generated Content: Coach reports, chat replies and the coach’s assessment and recaps in public profiles are generated by artificial intelligence. They are provided for informational and entertainment purposes only, may occasionally be inaccurate or incomplete, and do not constitute professional sports, medical, or health advice. Always consult a qualified professional regarding injuries or health concerns.
- Data Processing: Only with your consent to AI processing, the following are transmitted to and processed by our AI infrastructure partner (Google, via Firebase AI services) to generate coaching content: aggregated statistics from your training sessions; your profile details, including your gender, age, height, playing hand, handicap and golf profile details; previous coach notes; and your chat messages. What exactly is sent is described in section 5 of our Privacy Policy. Your swing videos are never transmitted or analyzed for this purpose. Using the Personal AI Coach is optional.
- Cloud Storage: Coach reports and chat history are stored in your secure cloud account so that your coaching continuity is preserved across devices. You may delete individual reports or your entire chat history at any time directly inside the Application.
- One Report Per Training Day: The Application prepares at most one coach report per training day. If you delete a report, a new one will not be generated for the same day.
- No Liability for Training Outcomes: falbergolf.com, s.r.o. accepts no responsibility for sporting results, handicap changes, or any decisions made based on AI-generated coaching content, subject to section 9.
EU AI Act Transparency Notice. In accordance with Article 50 of Regulation (EU) 2024/1689 (the “AI Act”), we inform you that the Personal AI Coach feature — its daily training reports, chat replies, and the coach’s assessment and recaps in public profiles — and the replies in the support chat that are marked as AI-generated are produced by an artificial intelligence system, and these outputs are AI-generated content.
8. Community, Public Profiles & User-Generated Content
FG Vector offers optional community features that let you create a public player profile with a unique @handle, publish posts and photos, share session cards, single shot videos, results and coaching notes, follow other players, form friendships and leave comments (together, the "Community Features"). By using the Community Features you accept the rules in this section.
Zero Tolerance for Objectionable Content
There is absolutely no tolerance for objectionable, abusive, harassing, hateful, defamatory, obscene, sexually explicit or otherwise unlawful content or behaviour. You are solely responsible for everything you publish.
- Prohibited conduct: You must not post content that is illegal, infringing, hateful, threatening, pornographic or misleading, impersonate any person, upload another person's photo or personal data without consent, spam or advertise, harvest data, or attempt to bypass blocking or moderation.
- Impersonation & reserved names: Handles that combine the name of a professional tour player (PGA, LPGA, LET, DP World Tour, LIV) or another public figure are reserved to prevent impersonation. If a name that is genuinely your own is blocked, contact us at [email protected].
- Shot video posts: When you post a shot ("Post to FG Vector"), the exported video of that shot and a thumbnail image are uploaded to our cloud storage and shown on your profile and in the Feed of your followers and friends. Before posting, make sure the video does not show other people who have not agreed to appear in it, or anything else you are not entitled to share.
- Reporting & blocking: Every profile, post and comment can be reported, and any user can be blocked, directly inside the Application. We review reports of objectionable content and act on them — removing the content and ejecting the responsible user — within 24 hours. Anyone, including people without an account, may also notify us of content they consider illegal by writing to [email protected], stating where the content is and why it is illegal.
- Our moderation rights: We may remove content, restrict features, suspend or delete a public profile or @handle, and ban a user who breaches these rules or the law. We act diligently, objectively and proportionately; in urgent cases (for example, clearly illegal content or a risk of serious harm) we act without prior notice. Unless the law prohibits it, we tell the affected user the reason for our decision, and the user may contest it by writing to [email protected]; we will review the objection without undue delay.
- Your content: You keep ownership of the content you publish and grant falbergolf.com, s.r.o. a worldwide, non-exclusive, royalty-free licence, for as long as the content remains published, to host, store, reproduce (including technical adaptations such as thumbnails and different formats) and display that content to other users within the Application solely in order to operate the Community Features. The licence ends when you delete the content or your account.
- Public visibility & control: Your public profile and posts are visible to other signed-in users of the Application, and your posts also appear in the Feed of your followers and friends. Do not publish anything you are not comfortable sharing publicly. You control the visibility of each section, can hide your profile, and can delete individual posts or your account at any time; deleting a post also deletes its photo or video and thumbnail from our cloud storage.
9. Warranties & Limitation of Liability
If you are a consumer, you have the statutory rights relating to digital content and digital services under the law applicable to you (in the EU, including the rules implementing Directive (EU) 2019/770); nothing in this Agreement limits those rights. Beyond these statutory rights, falbergolf.com, s.r.o. gives no additional guarantees — in particular, it does not guarantee that the shot statistics, which are estimates, will match the readings of any other device, or that the Application will operate without interruption or errors.
Critical Warning Regarding Application Deletion:
Uninstalling or deleting the FG Vector Application from your iOS device permanently deletes all locally stored content, including all recorded videos. Numerical statistics synchronised to your cloud account are restored when you sign in again, but your video library is not backed up to our cloud servers (the only videos we store are those you have published as posts, for as long as the post exists), so videos cannot be recovered after uninstallation. If you wish to preserve your swing videos, export and back them up to an external storage location before deleting the Application.
You are responsible for setting up your device and practice area safely (keep the phone and its stand out of the swing path and the flight of the ball). To the extent permitted by law, falbergolf.com, s.r.o. is not liable for damage resulting from your physical setup, such as a club or ball hitting your device, or for the loss of training data caused by hardware or connection failures outside our control.
Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our fault, for damage caused intentionally or through gross negligence, or any other liability that cannot be excluded or limited under the law applicable to you.
10. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Czech Republic. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence (Article 6(2) of Regulation (EC) No 593/2008, "Rome I").
If you are a consumer in the EU, you may bring proceedings against us either in the courts of the Czech Republic or in the courts of the place where you are domiciled, and we may bring proceedings against you only in the courts of your domicile. If you are a consumer outside the EU, you may bring proceedings in the courts of the Czech Republic or in any other court that has jurisdiction under the mandatory law of your country of residence. If you are not a consumer, the courts in Brno, Czech Republic, have exclusive jurisdiction.
Out-of-court dispute resolution: Please contact us first at [email protected]; we will try to resolve any complaint amicably. Consumers may also submit a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz), the body competent for out-of-court resolution of consumer disputes, or to a comparable body in their country.
11. Modifications to this Contract
We may amend this Agreement for valid reasons, such as changes in the law, security requirements, or changes to the features of the Application. We will inform you of material changes inside the Application or by e-mail reasonably in advance before they take effect; changes do not apply retroactively. Changes required solely to comply with the law, or that are only to your benefit, may take effect immediately.
If you do not agree with a change, you may stop using the Application, delete your account and turn off auto-renewal of your subscription before the change takes effect; your statutory rights remain unaffected. If you continue to use the Application after the change takes effect, the amended Agreement applies.
12. Competitions
The Application may offer optional competitions and challenges (the "Competitions"). Entry is always voluntary: you join a specific Competition from inside the Application and may leave it at any time. Entering costs nothing: there is no entry fee and no stake, and the outcome depends on your recorded training and performance, not on chance. Where a Competition is open only to subscribers (section 12.1), no additional payment is required to enter. These rules apply in addition to the rest of this contract.
12.1 Entering and eligibility
- Opt-in and consent: When you enter, you agree that your display name, @handle, profile photo, country and result may be shown to other players on the Competition leaderboard inside the Application. Leaderboards are not published on our website.
- Conditions of entry: A Competition may require an active subscription, a minimum number of sessions or a specific club. Any such condition is shown before you enter.
- Countries: A Competition, or its prize, may be limited to entrants from certain countries; any such limitation is shown with the Competition. A Competition with a prize is void where prohibited or restricted by law, and entrants from such countries are not eligible for the prize. We use the country and handicap in your profile to check eligibility and assign divisions.
- Age: To be eligible for a prize, you must be at least 18 years old. Younger entrants are eligible for a prize only with the consent of a parent or legal guardian and only where the law of their country allows it; we may ask for this consent to be confirmed before a prize is handed over and may hand the prize over to the parent or guardian.
- One account per player: Entering the same Competition from more than one account is prohibited and is grounds for disqualification.
12.2 Which shots count
Only shots recorded by the Application during the Competition period count. The following are never included in any score:
- practice swings (shots recorded without a ball);
- shots the Application automatically marks as "Not captured" (for example, when it could not capture the contact reliably);
- shots where the club used does not match the club selected;
- shots whose numbers the Application is still holding back until your calibration is completed (a shot with a measured ball speed is shown, and can count, straight away; the other shots can count once your calibration is completed and their numbers are shown);
- shots whose measured speed hit the physical limits of the model;
- shots played with a club other than the one the Competition specifies, where it specifies one.
A day counts as a training session when at least the number of shots set for that Competition was recorded on that day. The required number is shown with the Competition.
12.3 How each format is scored
Every Competition uses exactly one of the following formats. The specific limits for a Competition are shown with it and may be stricter than the defaults below.
- Number of shots: the total of qualifying shots, counting only days that qualify as a training session, and at most 150 shots per day.
- Number of sessions: the number of days that qualify as a training session.
- Training days: the number of days on which at least one qualifying shot was recorded. This format does not require a full session.
- Longest streak: the longest run of consecutive days that qualify as a training session.
- Longest shot, best smash factor: the single best qualifying shot, provided at least 5 qualifying shots were recorded.
- Best speed: only shots whose ball speed the Application measured from the video count; a speed you entered, a speed derived from distance or estimated from your posture, and the values the Application fills in for shots it could not measure never count. Unless the Competition states otherwise, the score is based on ball speed; where a Competition states club speed, it is the measured ball speed divided by the smash factor. The value of a training day is the median (middle value) of that day's three fastest measured shots, counting at most the first 150 qualifying shots of the day; your score is the value of your best day, provided at least 5 measured shots were recorded during the Competition.
- Average distance: the average of all qualifying shots, provided the minimum number of shots set for the Competition was recorded.
- Distance consistency: the statistical spread of your distances, where a lower value wins, provided at least 10 qualifying shots were recorded.
- Handicap improvement: the difference between your handicap at the start and at the end of the Competition period.
- Speed improvement: only measured shots (as for best speed) with the club set for the Competition count — the 7 iron unless the Competition states otherwise. A training session here is a day with at least 5 measured shots with that club, and its value is the median of their measured ball speeds. Your starting value is the median of your last (up to) 3 such sessions in the 30 days before the Competition starts, or before you entered where the Competition counts from entry; your current value is the median of your last (up to) 3 such sessions during the Competition. If you have no such session before the start, your first and your last (up to 3) sessions during the Competition are compared, and at least 2 sessions are needed. The improvement is calculated from the ball speed as measured, before any later change to the Application's calibration, so that a calibration change cannot create an improvement. Where a Competition uses club speed, the smash factor of your starting sessions is used for both values. Where several clubs count, the average of their improvements is used.
- Achievements earned: the number of badges earned during the Competition period.
12.4 Scoring, review and disqualification
- Scores are calculated by us, not by your device. The Application cannot write or alter a score, a ranking or an eligibility status.
- Recalculation: Scores are recalculated periodically and may change until the Competition closes, for example when data syncs late or a shot is corrected.
- Manual review: Implausible results are flagged and reviewed by us before results are declared final. Nothing is removed automatically.
- Disqualification: We may exclude an entry where, following the review described above, we have reasonable grounds to conclude that there has been manipulation of measurement, deliberate accumulation of shots without genuine practice, use of more than one account, or any other circumvention of these rules. We will inform the entrant of the exclusion and its reason, and the entrant may contest it by writing to [email protected].
- Estimated values: All shot metrics produced by the Application are estimates derived from camera, audio and motion data. They are not certified measurements, and results are compared between players on that basis.
12.5 Results and prizes
- Results: Final standings are published inside the Application after the Competition closes, at the moment stated with the Competition.
- Prizes: Where a prize is offered, it is described with the Competition. A prize may be supplied by a partner named with the Competition, but the organiser and sole sponsor of every Competition is falbergolf.com, s.r.o. Prizes are not exchangeable for cash unless expressly stated.
- Winner verification: Before a prize is handed over, we verify that the winner meets the conditions of the Competition, including a manual check that the winner's subscription is active where the Competition requires one. If a winner does not meet the conditions, or does not respond to our winner notification within the reasonable period stated in it, the prize may be awarded to the next eligible entrant.
- Taxes: Any tax arising from a prize is the responsibility of the winner, except where the law requires us, as the organiser, to withhold or pay it. Under Czech law, for example, the organiser may be required to withhold income tax from a prize whose value exceeds a statutory threshold; in that case we will proceed as the law requires and inform the winner before the prize is handed over. Winners may also have tax obligations in their country of residence.
- Changes and cancellation: We may amend the rules of a Competition, postpone it or cancel it for important reasons, in particular technical failure, insufficient participation or suspected manipulation. Changes do not retroactively affect results already achieved, unless this is necessary to correct a technical error or manipulation. Entrants are informed inside the Application.
- Final decisions and your rights: The final ranking is determined by our server-side scoring and manual review under these rules, and our decision on it is binding to the extent permitted by law. This does not exclude or limit any statutory rights you have, including the right to claim a prize you have duly won under these rules and the right to have a dispute decided by a court or a consumer dispute-resolution body.
12.6 Organiser and Apple's role
- Organiser and sponsor: The Competitions are organised and sponsored by falbergolf.com, the developer of the Application. Where a prize is supplied by a partner, that partner is named with the Competition.
- Apple is not involved: Apple is not a sponsor of the Competitions and is not involved in them in any manner. Apple bears no responsibility for a Competition, its conduct or its prizes. Any question, complaint or claim relating to a Competition must be addressed to us at [email protected], not to Apple.
